Fundación Pachamama Appeal for Re-Open Denied

By way of a bulletin, the Ministry of Environment has turned down Fundación Pachamama’s appeal to Ministerial Accord 125, which dissolved the organization in December of 2013.

In accord with its right to self-defense, Fundación Pachamama will appeal in competent courts, and will make the case known to international human rights organizations.

Quito, February 13, 2014: On the 12th of February, the Day of the Amazon, The Ministry of Environment of Ecuador (MAE) turned down Fundación Pachamama’s appeal of Ministerial Accord 125, which dissolved Fundación Pachamama in December of 2013, without any previous notification, without due process, without permitting the right to self-defense, and on the basis on unproved accusations.

In its response, the MAE states that it has demonstrated “with clear, precise, and punctuated reasons that there has been no violation of the fundamental individual rights established in Articles 76, 66 (13), 66 (6), 66 (26) and 82 of the Constitution of Ecuador”; consequently, “the Ministerial Accord 125 of December 4th 2013 is confirmed in all its parts”.

In addition, in the document, MAE refers to a supposed “administrative procedure initiated against the Fundación, dated November 12, 2013, for verification of the strict compliance of its aims and objectives”. The Ministry of Environment assures in addition that “the interested (party) has not established legal residency and is declared in default”. Given this statement, Fundación Pachamama wishes to clarify that it was not notified of this procedure, as the letter from the State assures. The Fundación will demand that MAE deliver this documentation, and the respective record of receipt of notification.

With the response from the Ministry, and in accord with its legitimate right to defense, Fundacíon Pachamama will appeal to competent courts to protect its rights, codified in the Constitution of the country. It will also bring the case before bodies that monitor compliance with human rights internationally.

Fundacíon Pachamama is an independent Ecuadorian organization, with more than 16 years of work, without ties to political parties, which does not oppose any government and believes in the collective work between civil society and the State. It does not promote acts of violence, as it believes that peace is the only mechanism of legitimate protest.  Similarly, it ratifies that not a single one of its eight members participated in the violent acts that occurred on November 28, 2013 in protests against the 11th Oil Round, as has been systematically claimed by various public institutions.
